In case you do not agree to the Terms and Conditions of Use and Privacy please abstain from using the Portal.

1. USE AND RESTRICTIONS.
Using the portal expresses full and unreserved adherence to the User Terms and Conditions of Use and Privacy Policy. Through the Portal, the user will access and/or use various services and contents (hereinafter as the “Services and Contents”), made available to users by the Tourism Trust of the State of Baja California Sur (hereinafter, “FTEEBCS”) and/or third party service and contents. The FTEEBCS has the right to deny, restrict or condition the user‘s access to the Website, in whole or in part, in its sole discretion, and to modify the Services and Contents of the Portal at any time without notice.

The user acknowledges that not all Services and Contents are available in all geographic areas and that some Services and Contents may only be used after the registration or prior to registration by the user and/or the payment of a commission, as indicated expressly in the corresponding “Special Conditions” (as such term is defined in paragraph 12).

2. INTELLECTUAL PROPERTY.
The intellectual property rights regarding the Services and Contents and the distinctive signs and domain of the Website, and the rights of use and exploitation thereof, including its disclosure, publication, reproduction, distribution and transformation, are the exclusive property of FTEEBCS. The user does not acquire any intellectual property by simply using the Services and Contents of the Website and never such use will be considered as an authorization or license to use the Services and Content for purposes other than those contemplated in the present Terms and Conditions of Use and Privacy Policy.

3. THIRD PARTY INTELLECTUAL PROPERTY.
User agrees that the provisions set forth in the preceding paragraph 2 in respect of the ownership rights of FTEEBCS also apply to the rights of third parties in respect to the Services and Content of linked pages from the Website.

4. PERMITTED USES.
The use of the Services and Contents of the Website is the exclusive responsibility of the user, who in any case must proceed according to the functionality permitted in the Website and authorized uses of these Terms and Conditions of Use and Privacy, therefore the user agrees to utilize them so as not to violate the rules of use and etiquette of the Internet, the laws of the United Mexican States and the current legislation of the country in which the user is to utilize them, with good manners, dignity and taking into consideration the rights of others. The Website is for personal use only and the user therefore may not market in any way shape or form any of the Services and Contents.

5. PROHIBITIONS.
The user is not entitled to place hyperlinks into and from the Website, nor the right to place or use the Services and Contents of the Portal in sites or own pages or third parties without prior written consent of FTEEBCS. The user will not have the right to restrict or inhibit any other user from utilizing the Website.

6. QUALITY OF SERVICES AND CONTENTS.
Neither FTEEBCS, nor its suppliers or business partners shall be held liable for any loss or damage suffered by the user as a result of inaccuracies, typographical errors and changes or improvements performed periodically to the Services and Contents. The recommendations and advice obtained through the Website are of a general nature, so should not be taken into account in making personal decisions. For this you should consult an appropriate professional who can advise the user according to their specific needs.

7. GOODS AND SERVICES OF LINKED THIRD PARTIES.
Regarding the services and content provided by third parties in or by links to the Website (such as links, banners and buttons), the FTEEBCS is limited, for user convenience, to: (i) inform the user about the same, and (ii) to provide a means for contacting the user with suppliers or sellers. The products and/or services that are marketed within the Website and/or third party linked sites are supplied by independent retailers to FTEEBCS. The FTEEBCS is not and cannot be considered as a supplier of goods and/or services offered in these pages and/or sites. The inclusion of these pages and/or links does not imply approval, support, sponsorship, recommendation or guarantee, from the FTEEBCS, services and goods sold in the same or the content of these pages. There is no labor relationship, association or partnership between FTEEBCS and such third parties. Any advice, declarations, information and content of linked third-party sites or within the Portal represents the opinions and judgments of such third party consequently the FTEEBCS not be liable for any loss or damage suffered by the user as a result thereof including, without limitation but not limited to, damages for loss of data or programs.

8. CONFIDENTIALITY.
Each transaction that you carry out with a linked Web site by a third party or as a result of your browsing to http://visitbajasur.travel/ is solely between you and such third party or linked website. By using this website, you understand and agree that the FTEEBCS has no responsibility for these transactions. You further agree to exempt the FTEEBCS of any responsibility and that you shall exempt the FTEEBCS of any judicial process and/or claim, in the event you should have a dispute or problem for the transaction.

9. USE OF NON CONFIDENTIAL INFORMATION.
By using the Website, the user authorizes the FTEEBCS to use, publish, reproduce, disclose, communicate publicly and transmit non-confidential information, in accordance to the terms of the provisions of Article 109 of the Federal Law on Copyright and section I, Article 76a of the Federal Consumer Protection Law.

10. COOKIES.
Users who access the Website, agree to receive the cookies sent by FTEEBCS servers. “Cookie” means a data file that is stored on the hard disk of the computer when the user accesses the Portal. Cookies can contain information such as the identification provided by the user or information to trace the pages that the user has visited. A cookie cannot process data or information from the user’s hard disk nor read cookie files created by other sites or pages.

11. ACCESS CODES AND CONFIDENTIAL NUMBERS.
At all times, the user is solely responsible to maintain all numbers related to their accounts, which permit access to the Services and Contents of the Website, as well as third party pages, personal passwords, access codes and confidential numbers.

12. AMENDMENTS.
At any time The FTEEBCS has the right to modify the Terms Use and Privacy Policy. Consequently, the user must carefully read the Terms of Use and Privacy whenever he intends to use the Website. Certain services and content offered to users and/or through the Portal are subject to special conditions that replace, complete and/or modify the Terms of Use and Privacy (hereinafter, the “Specific Conditions”). Consequently, the user must also carefully read the corresponding Specific Conditions before accessing any Services and Contents.

13. APPLICABLE LAWS AND JURISDICTION.
For the interpretation, fulfillment and execution of this Agreement, the parties agree that the Federal laws of the United Mexican States and the courts in La Paz, Baja California Sur will apply, expressly waive any other jurisdiction that could applicable due to their present or future domiciles.
